I attempted to order 8 of a closeout PNY smart media unit from Ebuyer @ $6.29 each, along with a "1 x Carry CFCA PC Card CompactFlash Adaptor" @ $5.99. This order was generated Wed. 9/24/03.
On 9/25/03 I was informed by E-mail that the the latter item (flash adaptor) was no longer available. I also received an e-mail to call their offices to confirm that I still wanted the memory. I called their Arizona office on 9/26. They said that they still had the items available, and that they would ship that day.
On the morning of 10/1/03, I received two more e-mails from e-buyer indicating that the memory was no longer available and that the order would be flushed.
I contacted them by e-mail at "orders@ebuyer.com" at 7:05 AM EDT on 10/1/03. The text follows:
You are hereby advised that I will be filing complaints with the following organizations regarding your non-performance on this matter:
1) State of Arizona Attorney General's Office (Consumer Complaint Division).
2) Phoenix Arizona Better Business Bureau.
3) UK based consumer complaint organizations, as the e-mails I have received about the problems all appear to originate in the UK.
4) Various Web-Based forums.
At the time the order was placed, your web site showed 19 of the item in stock (PNY 32 Smart Media @ $6.29). I was told verbally last Friday that they would, in fact, be shipped when I called your "800" number. Now, I am told you cannot get them.
That is FRAUD where I come from. I expect you to manage your business in a manner that allows you to manage your inventory better, not to mention your customer relations.
You have until 5 PM US Eastern Daylight Time 1 October 2003 to find a solution. May I suggest that you substitute another brand of the item and sell 8 of them to me @ $6.29 each with free shipping to me. This, of course, may mean you are selling at a loss, but this would forestall my complaints about the matter.
I am also experiencing similar complaints with a competitor of yours, "buy.com" over a similar memory deal. It seems companies like yours feel that they can do whatever they want with order fulfillment, and damn customer service.

At 8:30 AM 10/1/03, I tried access their system to use the "e-notes" feature they want customers to use...well, well, well...it appears that they have deleted my account from their database without notifying me! Not only am I not able to log in, I can't recover my password (yes, I know my e-mail address)...
Ebuyer appears to be a UK based company that has an office in the Phoenix AZ area. This treatment appears to the the standard British treatment of a PITA situation.
