The landlord must hold it aside in a special account (escrow)...
Is this a MA thing? Here in MN, landlord can keep (or spend) the deposit any way he likes before it is due back, with the requirement that monies earn 3% a year interest.
I had on several occasions tenants not paying the last month rent, justifying it by offering me to keep their 1 month rent deposit. This is the reason I try to collect the depost of 1 month rent $100 or so where possible.
