Receive no shipment and Buy.com refuse my claim!

I order 1GB USB flash from Buy.com around the end of October thinking that I had scored a great deal. Two weeks had past and I did not receive it. Checking on the FedEx ground tracking number from Buy.com, the product had already delivered to my address left it at my front door. I used to have the courier drop the shipment at my front door all the time and have no problem except that I got my neighbor packages sometime and I have to hand them to my neighbor.
I contact buy.com and they basically refused my claim by referring to one of the long listed policy as I listed at the end of my review. I contacted FedEx and they said if you want to even file a claim, the merchant or the shipper has to do it. So that's left me with nothing I could do.
So this is truly a classic BUYER BEWARE. I would like to pass along my true experience. Hopefully you don't ever have this problem or better yet, avoid buy.com altogether. I know I will.

I do understand your point of view regarding the delivery of your order and apologize for the inconvenience. However, although we always try to do everything in our power to resolve every customer issue, unfortunately at this point we are unable to assist you further in this matter.
Per company policy: "Title to goods passes to you upon delivery to the common carrier."

Basically this says that once a product is in transit via the shipping carrier, the ownership of the product has passed from Buy.com to the customer. It is the customer's responsibility from this point forward to make sure someone is at the delivery address provided to accept the package. If no one is available at this address at the time of delivery, the carrier is authorized to leave the package at the door and the order is considered completed at that time.
