The Bottom Line Whether or not your child qualifies for EYS, now is the time to address the issue.

What is it?
EYS is extended year services. This is the extension of special education related services beyond the normal school year. This can apply to “school” itself, or components that make up the special needs child’s day such as speech therapy, occupational therapy, and/or adaptive physical education.

It is February. Why do I need to think about this now?
Many states have early deadlines for requests to add EYS to a child’s IEP. You cannot simply request it either; it has to be approved by the ARD team and by your district. This can be a tedious process. Furthermore, if the parents disagree with the decision made they need to have time before the regular school year ends for due process, i.e., review and appeal.

The school district pays for this?
A school district is not required to provide EYS unless there will be significant regression of skills or knowledge seriously affecting progress toward self-sufficiency, or that benefits accrued to the child during the regular school year would be significantly jeopardized if he were not provided EYS. In other words, depending on your state and district, probably not unless your child is learning critical life skills.

But how do they decide if my child qualifies?
Six main factors are considered: Regression and Recoupment, degree of progress, emerging skills or breakthrough opportunities, interfering behaviors, nature and severity of the disability, and special circumstances.

That’s nice. What does it mean?
Regression means a substantial loss of any critical life skill. This does not apply to the “normal” loss of skills any student has over a school break.

Recoupment is the amount of time it will take the student to regain the skill if lost. It is important to note 60 days recoupment is considered satisfactory.

Degree of progress means the student's progress on any IEP objectives targeting critical life skills, and determine whether, without EYS, the student's degree of progress on those IEP objectives is likely to prevent the student from receiving some educational benefit from his or her educational program during the regular school year.

Emerging skills or breakthrough opportunities means whether any IEP objectives targeting critical life skills are at a breakthrough point.

Interfering behaviors means whether any IEP objectives targeting interfering behaviors, such as stereotypic, ritualistic, aggressive, or self-injurious behavior(s) have prevented the student from receiving some benefit from his or her educational program during the previous school year, or whether the interruption of programming which addresses the interfering behavior(s) is likely to prevent the student from receiving some benefit from his or her educational program during the next school year.

Nature and severity of the disability means the nature and severity of the disability is such that the interruption of instruction caused by the school break on the critical life skills on the IEP is likely to prevent the student from receiving some benefit from his or her educational program during the regular school year.

Special circumstances means the interruption of instruction caused by the school break on the critical life skills on the IEP is likely to prevent the student from receiving some benefit from his or her educational program during the regular school year.

What does some benefit mean?
Some benefit means an improvement in meeting the critical life skill objective as written in the IEP for the current school year.

So, what does all this mean to my child?
If you think your child may qualify, or may need regardless of qualification, EYS now is the time to address the issue. Call an ARD and discuss your position with attention to critical life skills and regression/recoupment. Decide for yourself if your child does not met the stringent criteria to qualify for free services are you willing to and can you afford to pay for similar, or better, more appropriate, services.
