Jackpot winner but...Pogo didn't pay!
by kathymcd | Jun 20 '07
Dear loyal Pogo.com players, I feel that I must share my most recent enlightenment on pogo.com. I have been a paying member of pogo.com since 2001. On April 18, 2007 I hit the JACKPOT WINNER on my spin! I was in total shock. My win was ...

I too have that problem with Monopoly. I have been playing Pogo since 2001 and have been ripped off by many of there games. They have taken money from my bank accout for Club Pogo, even when I have closed my account. EA sports out sources to India, and if you don't know, that country is out to screw all the Americans they can. I am hoping the FBI will investigate them. They are 1 big scam. Charles.

I hope you get your money but I'm doubtful. Seems a lot of people have been cheated by Pogo after researching the internet. EA has a lawsuit going on right now re: the game, Spore, which puts illegal stuff on ppls hardware when downloaded, from my understanding. My complaint is simple: I can't even get a fair gameplay in there. I was playing Pogo's Monopoly and my one last opponent had no money, but suddenly was able to buy houses/hotel wayyyy over 14.00 with only 5.00 that she got landing on the Free Parking space (one of many instances). I think Pogo cheats in many ways.

You have 2 years minus one day from date of win to do something.
I have contacted all winners I can find who have been falsely accused and I am adding their complaints (with their permission) and sending to the BBB.
I intend to file a formal complaint of computer fraud/identity theft with the U.S. Department of Justice this week.
There are just too many of us been accused of cheating by Pogo when we win!!! The burden of proof is on them now!

Greetings,

"Cheating" or having "3rd party programs" on your computer is something that you may be doing without your knowing. These external programs can be obtained from websites other than www.pogo.com. Our detection system will alert us of certain activity during the normal process of any prize winner. Then an agent will manually review the account for specifics. It appears that your account has been flagged as this and a prize cannot be awarded. I suggest that you review your system and remove and of these programs to be able to be eligible in the future. The results of account audits is internal information only and is not released for public record.

Thank you,
Jeff

Wow - I can't believe they refused even a $5 payout, that is pathetic. I understand trying to get away with not paying the large amounts but $5?? SAD!!

Yes...You can file a complaint with the BBB on-line...I did. They are good too. They have stayed in active communication with me. I am in the process of getting complaints about Pogo winner's, being falsely accused, together to send to them and the AG'S Office. The more I find - the stronger the case against a company "acting in bad faith".
You can email me for the specifics.

Pogo Winner Denied Win (Reply to this comment)
by pamiss45
I too won an instant cash prize on 01/31/2008. I immediately responded to Pogo's e-mail to fill in the winner's form. I was issued a winner's badge which I put up by my name and the room and I joked how to spend the money.
On 02/15/08, I was notified n by Pogo e-mail that they had detected that I had used a "cheat" program or an "auto-run" program. I immediately responded that I did not! I asked for any/all information they had on this under the Federal Freedom of Information Act (FIOA). Pogo has refused to give specifics as they know it can be proven it was never on the computer.
I filed on-line: a complaint with the Better Business Bureau (active), the California Attorney General's Office (active), and the FCC (awaiting response).
I encourage all falsely accused Pogo winners to contact these offices to stop this company from "acting in bad faith" and to stop what appears to be criminal activity.
I have numerous complaints like mine that I have found on web sites and am sending those to the BBB and AG's Office.

My take on it. (Reply to this comment)
by nomanisland
Please read the terms and conditions.

EA / Pogo can be of the opinion that somebody cheated and disqualify that person for most any reason.

i.e. The rules seem to specify that you may only have one game open at any given time.

If someone fails to close a game window before opening another game, then Pogo can disqualify them from prizes forever.

It's like those rebates that are "limited to availability." Once the two rebates are given out, then the remaining two million forms are worthless. Or if you forget to dot an i or cross a T on the form, then your disqualified for poor spelling/writing or whatever.

The rebates/prizes are at the sole discretion of the company not the customer, so it's tough luck sometimes.

Granted its rude, misleading, bad business etc. to flat-out deny 99.999% of prizes or rebates, but those terms and conditions may make it borderline legal.

sensitivity of the information. (Reply to this comment)

"As far as the details of the date, time and what game, we are not able to provide that information due to the sensitivity of the information."

-------------------------------------------------
Sensitive = liable or possibly self incriminating?

-------------------------------------------------
Sorry, I'm sure y'all spent a lot of time to get the phantom jackpot. Has anyone actually claimed the prize and received it? There may be a happy story too?

Hey, just thought you would like to know I am gathering names for a pogo.com class action, I do not know how to get ahold of you. I have started an MSN Group called Cheated by Pogo. Please get ahold of me. We are going to do something with these guys. This is not fair, like you I won a jp and didn't get it. I threatened them with a class action and now they will not talk to me, but referred me to their legal dept. What a waste and fraud!

Wow -- I've now had 4 others contact me in the past month that they too lost their jackpot wins...I wonder how many others this happened to? Any thoughts on where to file a complaint, pogo/EA Games is not a member of the BBB.
