Required item was missing from iPod Touch 32 GB 3rd Generation

This order was my first purchase from eCOST. (Order date was June 30, 2010) I purchased an iPod Touch 32 GB 3rd Generation. When it arrived I opened it and discovered that the factory seal was broken/cut on one end of the plastic box. The iPod is in perfect condition and functions as expected. My problem is that the "earphones with remote and mic" was not included in the package. Just the standard earphones were in the package. When I called to talk with a representative, I was told that since the product was "refurbished/reconditioned" and that was the way it was received from the factory. I consider this to be fraud because regardless if an item is refurbished/reconditioned, does not mean that items that are considered part of the original packaged product which has the "earphones with remote and mic"can be left out of the refurbished/reconditioned product. I had to purchase the "earphones with remote and mic" from Fry's Electronics in Phoenix, Arizona at a cost of $30.59. This ended up costing me a total of $260 for a refurbished/reconditioned iPod Touch 32 GB 3rd Generation. How will you eCOST compensate me for my additional expense. Your advertising of this item is not legal. It amounts to bait and switch. An individual should expect to receive the proper included items as a new item, even if it is refurbished/reconditioned. I was prepared to purchase another iPod Touch 32 GB for my wife, however, not from eCOST. Please provide me with a satisfactory response and compensation.
