Scuffed DOA headset sold as new at ecost.com

I ordered a Jawbone Icon Rogue on sale at ecost.com. I jumped at the low price, not concerned that it came in "OEM/Non-Retail Packaging" because it was listed as new. The headset arrived two weeks later, DOA and with scratches on it. New? Really? I'm ok with a few scuffs, but Jawbone support (VERY helpful!) took about 30 seconds to diagnose it as a bad unit.
When I called ecost's customer support, they said they'd credit my account after I returned the item, since it's no longer in stock. While that's better than nothing, I don't want to USE that credit! Getting a DOA item is bad luck, but when it's supposed to be new and CLEARLY isn't, that reflects on the seller. I asked if they'd be willing to send a new one out, but the man on the phone (who I could barely understand through his accent) insisted that this was company policy. Even when it comes back in stock, it won't be at the sale price I originally paid so, if I want my headset, I'll have to shell out the difference. Not an experience I'd like to repeat! This is definetely the last time I buy something at ecost.com, no matter how low their prices are.
I'll write a bit about the retailer itself, not just my personal experience with them. The main reasons to buy from a specific online retailer is the price and service. Every day, ecost.com has special prices on several items - occasionally one of these will be of interest, but they tend to be fairly useless. Ecost.com has a pretty standard selection of electronic merchandise and a few other random items (like sports equipment and furniture), but items priced below the online average tend to go out of stock quickly. The site is easy enough to navigate, but nothing special.
