BAIT AND SWITCH: misleading ads, refurbished equipment sold as new, late delivery, terrible customer service

Ordered a laptop ( Toshiba Portege 4010 ) in Dec 2002.
Website listed it as NEW and in stock. Ordered on the phone.
vendor confirmed laptop was in stock. Made Purchase with
overnight shipping. After Laptop did not arrive on time.
Called and they said it had shipped. Waited again... made
several calls. Customer service said they had no "idea what
happened.", then they said that Toshiba "shipped it to them
on accident" and that they had shipped it to me. When
asked for a tracking number they made excuses about how it
hadn't gone through their database yet. Laptop finally
arrived after 1 more week. Turns out the Laptop is
REFURBISHED. Complained and they said that they would give
it an extra 3 year warranty for free. At the time that
sounded reasonable, but only because the user who I ordered
this for had a very important conference that she was to
take this to, days away. After the conference was over, it
was found that the CDRW/DVD combo drive that was supposedly
included was actually only a DVD drive. contacted customer
service, "dont know how this could happen" blah blah...
said they would ship a new drive and gave me an RMA number
and said they'd ship out 2nd day air. Waited one week...
waited 1 more week. No drive. Called them again. They
couldn't find my order. They when they finally found it,
they said that they don't know why it didn't ship, and said
they'd ship it out 'right away". I asked for them to call
me and give me a tracking number when it shipped. 1 week
goes by, another week goes by. Called again. Now they
remember who I am and one guy even knows my story directly.
He claims to sympathize, but I still as of Monday February
24,2003 DO NOT have the drive. 77 days after we ordered we
still do not have what was advertised.
