I marked unhelpful because the overdraft was, at your admission, the fault of a merchant's overcharge. You also said the account was overdrawn. My credit union (I have multiple accounts) would also charge me overdraft fees in this case unless I have overdraft protection. Have you checked what other banks would do in the same situation?
