I signed up with Golds Gym in Totowa NJ back in August of 2004. I signed a contract for 13 months as sold to me by one of the sales reps named Joe. As I was looking over the contract I noticed it was worded kind of funny.
The contract said it expired in 13 months, but after the contract expires, I would have to send written request to cancel the membership and that I would still be responsible for membership fees 60 days after cancellation.(If the memebership is cancelled why do I have to pay for another two months?)I dont get it, why is the contract written for 13 months term? Shouldnt it be written for LIFE TERM, cancellation by written request only + 60 days ?
Anyway, after reading that, I specifically asked Joe, what were to happen if I moved out of state ? He said, "No problem, just come in and I will cancel the membership."
Well 12 months later, August 2005, I went in and told Joe I would be moving to Florida and would appreciate it if he honored his word. He asked me for proof of relocation, which I supplied, and he then assured me there was no problem and my membership would be cancelled immediately without penalties.
I then went about life until a year later September of 2006, when I get a phone call from ABC Financial telling me my account is past due. I know I can be ditsy and dont scan my credit card statements, but it turns out that for the entire year I was still being billed for the membership that I had cancelled ! The fee was coming direct out of my credit card, and since my credit card expired in 9/2006, it caused the fee to bounce and they are expecting me to pay all past due amounts since september (200 bucks) plus late fees !!!
All of this for a gym that I signed up for, and never even showed up !!!! I understand not showing up is my fault, and I know I had to pay for the first year regardless of my attendence, but we are talking about a year and three months after expiration and still im being billed !! Now thats just crazy.
The ABC financial company referred me back to the contract and pointed out the fine print where it was written that I need to send written request to cancel the membership, they also advised me they were sending me to collections and that I would be responsible for the membership fees for sixty days after they receive the cancellation request. I explained to them my conversation with the sales rep and they basically told me that I was out of luck.
Now here is were its gets even better !!!!
I called the gym in Totowa and spoke to the owner Mike Picarelli, whos exact words to me were... "Joe and all of our employees are trained to give out the same procedure" That to me translated into.. our employees are trained to do and say whatever it takes to get the sale.
I told him I would be writing a blog about my expierence with the gym, and that I would be quoting his words, to that he reacted with an angry attitude and began basically yelling at me and hanging up the phone on me until he got another employee to tell me he is not available. Not only that, but before he disconnected the call, he said, "we could do this the easy way or the hard way".
So in summary, they got my money, my credit, my signature, on fine print. They are nice when they want you to sign up, and they threaten when you want to cancel.
Now thats what you call customer service !!!!!
